Chapter 13 bankruptcy allows debtors to re-arrange their finances to repay their debts over a 3-5 year period.
Debtors who own homes and want to stop foreclosure and debtors who do not qualify for Chapter 7 bankruptcy due to their income and expenses may both file Chapter 13 to receive a fresh start in 3-5 years.
Like Chapter 7, relief from lawsuits and debt collectors occurs immediately upon filing the Chapter 13, through the “automatic stay”. Once approved, the monthly plan payment is generally much less than pre-bankruptcy debt payments, with the exact amount determined by the debtors’ income, expenses, and assets. The debts paid through the plan will be considered paid in full at the end of the 3-5 year period and the bankruptcy court will order a discharge on these debts.
